Turks & Caicos Injunction
In August 1999 the Investment Consortium purported to hold a Board Meeting and remove B Hansen, and his appointees from the board of Shanghai Links Executive Community Ltd. There could not have been a Board Meeting the day Vincent Warner, acting on behalf of the Minority Investor Group, and directed by Kurt Roeloffs of Bankers Trust, because a Typhoon had caused the closure of the Hong Kong Chep Lap Kok Airport after an Airplane crash.
As a consequence Richards Butler, acting on behalf of Hansen and the majority shareholders, secured Leading Counsel Opinion of the former Chief Prosecutor of Hong Kong, Alexander King QC, that the Minority Investment Consortium had issued a false instrument, and had forged a Board Minute. Shanghai Links Executive Community Ltd, the parent of Shanghai Pudong New Area Links Executive Community Ltd (PRC Company), is a Turks and Caicos Islands ("TCI") registered company. Therefore the Board was formed under the laws of the TCI.
Carlos Simons, a Barrister from the TCI, was engaged to obtain an injunction against the Investment Consortium. An injunction was issued by the Turks & Caicos High Court against the Minority Investment Consortium, and in favour of B Hansen and the Sealand Housing Corporation majority shareholders during the northern Autumn of 1999.
